Privacy Policy

About this Privacy Policy

Our privacy policy outlines how SPI New Media, Structured Property Investments and our related businesses (SPI) manage personal information. It applies to any personal information you provide to us and any personal information SPI collect, use, disclose or handle about individuals from other sources. Updates of our privacy policy can be accessed by contacting our office or via our websites.

National Privacy Principles and the Privacy Act

Effective from 21 December 2001, SPI is bound by the Privacy Act 1988. This Act sets out standards to be met when collecting, using, disclosing and handling personal information. SPI has always valued the privacy of personal information.

Our reasons for collecting personal information

We collect personal information to offer, provide, manage and administer the products and services we offer. If you would like any information on these services and products please contact us.

We also collect personal information so we can identify and develop products and services that may interest you, conduct client satisfaction research, establish, develop, and administer associations and other arrangements with third party organisations in relation to the promotion, administration and use of our respective services and products.

We usually collect personal information that includes your name, your business, residential, postal and e-mail address.

If you do not provide us with the information we request, SPI or those involved with providing the services or products, may not be able to provide the appropriate level or kind of service or product.

How we collect personal information

We usually collect personal information directly from you; however in some cases we may collect it indirectly from a third party.

As an example, an existing client may tell us about other persons wanting to benefit from our products or services. We may also collect information from our own representatives, advisors or another third party or through publicly available sources.

Who we disclose personal information to

SPI have a duty to maintain the confidentiality of our clients' affairs and your personal information. This duty of confidentiality applies at all times unless you consent for us to disclose information or we are compelled to do so by law.

We disclose personal information to third parties who SPI believe are necessary to assist us in providing, managing and administering the products and services we provide and who require this information to help us.

What you need to do for us

If you provide SPI with personal information about other individuals, we rely on you to have made or make them aware that you will or may provide their information to us. This includes telling them the types of third parties SPI may provide it to, the relevant purposes we and the third parties that receive this information will use it for, and how they can access it, as stated in this Privacy Policy. If it is sensitive information we rely on you to have obtained consent for the above. If you have not done these things, you must tell us before you provide SPI with the relevant information.

If you collect, use, disclose or handle personal information on our behalf, or receive it from us, you and your representatives must meet the relevant requirements of the National Privacy Principles set out in the Privacy Act 1988 and only use and disclose it for the purposes SPI agreed to.

Security of your personal information

Your personal information may be stored in hard copy files and documents, as electronic data, or in our software or IT systems. SPI has a policy to protect all personal information that we hold from misuse, loss, unauthorised access, alteration and disclosure. In this regard, we have a process of security, which includes:

  • security measures for accessing our systems
  • security measures controlling access to our office premises where records are kept
  • confidentiality requirements on our staff and representatives
  • policies on document storage security
  • website protection measures

Receiving unwanted product and service information

SPI may send you information about services or products, or disclose your personal information to other organisations offering services and products that may be of interest to you. If you do not wish this to happen, you can advise us of this at any time by contacting us.

If you request us, we will provide you with access to the information we hold about you unless there is a reason not to which applies under the National Privacy Principals. Your right to access this information may be affected if:

  • access would pose a serious threat to the life or health of any individual;
  • access would have an unreasonable impact on the privacy of others
  • the information relates to commercially sensitive material
  • access would be unlawful or denying access is required or authorised by law

access would prejudice law enforcement activities relating to criminal activities and other breaches of law, public services and safety or security function.

Legal dispute resolution proceedings

If we don't provide you with access, we will tell you why and inform you of the reasons relied upon. You can also gain access to correct or update your personal information. Contact our office and we shall attend to your request in a reasonable time.

Credit Card Transactions

We do not store your credit card details and we will take all reasonable steps to protect your personal information from misuse, loss or from unauthorized access, modification or disclosure. Credit card transactions with us are processed by a third party merchant provider. When using your credit card in transactions with us, your details are protected by a secure data encryption process through 128 bit (or higher) SSL encryption. This process is identified by a padlock symbol appearing on the page when submitting your details.
